General Terms and Conditions of Sale (GTC)
Article 1 – Purpose and identification of the seller
These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sale of window films (solar films, privacy films, safety films, decorative films or similar products), manufactured exclusively to measure, concluded remotely via the website CAPTAIN FILM.

The CAPTAIN FILM website is operated by the company SARL COSSE & CO.
Article 2 – Scope of application
These GTC apply, without restriction or reservation, to all sales of products carried out by the company SARL COSSE & CO to private consumers, within the meaning of the Consumer Code.
Any order implies the full and unconditional acceptance by the Customer of these GTC, to the exclusion of any other document.
Article 3 – Products
The products offered are custom-made window films, intended for windows, glass walls or similar glazed surfaces.
The essential characteristics (type of film, solar performance, opacity, safety, dimensions, tolerances) are specified on the website.
Visuals, photographs, simulations and renderings are provided for information purposes only and have no contractual value.
Article 4 – Measurements – Customer’s responsibility
The Customer is solely responsible for the accuracy of the dimensions, quantities and technical information provided when placing the order.
No verification of measurements is carried out by the Seller.
Any measurement error, technical misjudgment or incompatibility with the existing glazing shall not give rise to any liability on the part of the Seller and shall not entitle the Customer to any exchange, refund or credit.
Article 5 – Order
The ordering process includes :
- Selection of the product and customization,
- Review of the order summary,
- Express acceptance of the GTC,
- Full payment.
Validation of the order constitutes an electronic signature and irrevocable acceptance.
The Seller reserves the right to refuse or cancel any order in the event of an obvious error, suspected fraud or a prior dispute.
Article 6 – Prices
Prices are expressed in euros (€), all taxes included (TTC), for sales in France and within the European Union.
For sales outside the European Union, prices are indicated excluding taxes. Customs duties, local taxes or import charges remain the sole responsibility of the Customer.
The applicable prices are those in force on the date of the order.
Article 7 – Payment
Payment is due immediately and in full at the time of ordering.
Accepted payment methods: [credit card, bank transfer, PayPal, etc.].
Any order not paid in full will not be manufactured or shipped.
Article 8 – Custom manufacturing – No right of withdrawal
In accordance with Article L221-28(3) of the Consumer Code, the right of withdrawal is expressly excluded for products made according to the Customer’s specifications or clearly personalized.
No cancellation, modification, return or refund may be accepted after the order has been validated.
Article 9 – Delivery
The products are delivered to the address provided by the Customer.
Manufacturing and delivery times are indicative only. Any delay may not, under any circumstances, justify cancellation, refund or compensation.
The transfer of risks takes place upon handover of the parcel to the carrier.
The Customer must check the condition of the parcel upon receipt and notify any reservations within 48 hours, supported by evidence.
Article 10 – International sales
The Customer is responsible for ensuring that the products comply with the legislation of the destination country.
The Seller shall not be held liable in the event of customs refusal, seizure, delay or destruction of the parcel by local authorities.
Article 11 – Retention of title
The products remain the exclusive property of the Seller until full payment of the price, in principal and accessories.
Article 12 – Legal warranties
The Customer benefits exclusively from the statutory warranties :
- the legal warranty of conformity (Articles L217-3 et seq. of the Consumer Code),
- the warranty against hidden defects (Articles 1641 et seq. of the Civil Code).
Any claim must be made in writing and accompanied by supporting documents.
Article 13 – Exclusions and limitation of liability
The Seller shall not be held liable for :
- incorrect installation or handling,
- incompatibility with specific glazing,
- use not in accordance with the intended purpose,
- indirect damages (loss of business, loss of opportunity, financial loss).
The Seller’s liability is strictly limited to the amount of the order.
Article 14 – Personal data
Personal data are processed in accordance with the GDPR.
The Customer has the right of access, rectification, objection and deletion.
Article 15 – Intellectual property
All elements of the CAPTAIN FILM website remain the exclusive property of the company SARL COSSE & CO.
Article 16 – Mediation
In accordance with Articles L612-1 et seq. of the Consumer Code, the Customer may have free recourse to a consumer mediator.
The mediator’s contact details will be provided on request or specified on the website.
Article 17 – Applicable law and jurisdiction
These GTC are governed by French law.
In the event of an international dispute, the courts having jurisdiction over the Seller’s registered office shall have exclusive jurisdiction, subject to mandatory consumer protection provisions.
